or for a one time construction project. 40 yards dumpster, best for large companies, construction projects and major renovations. Base charge will be pre-paid by customer before dumpster delivery unless otherwise agreed in writing. Customer is subject to additional charge (if applicable) for unauthorized material in dumpster, overweight fee. Customer agrees to pay any additional charges due to excess tonnage in the container or additional charges for containers that sit in excess of 10 days without activity will be automatically charged to the Customer credit card at the rates $80 per ton. In the event of breach of our agreement with Global Waste Management, LLC. and the assignment of Customer account to a collection agency, Customer agrees to pay reasonable attorney fees and court cost.
- Global Waste Management, LLC. shall not be responsible for damage to Customer’s pavement or other surfaces or any road reasonably necessary to perform the services requested and required or damage to utilities, property, lawns, fences or shrubbery.
- Customer warrants that the waste or material placed in the dumpster will not contain any unacceptable, hazardous, toxic, flammable, medical or infectious waste, paint, asbestos, freon, tire or radioactive waste or substances as defined by federal, state and local law or regulation. If found in dumpster, material will be returned to the customer and extra charges will be applied.
- Customer acknowledges that it has the care, custody and responsibility for the dumpster while on its premises. Customer will see that the dumpster is loaded uniformly: material does not extend beyond the top and sides of dumpster and does not exceed the weight load limits of the dumpster.
- Customer expressly agrees to defend, indemnify and hold harmless the Company from and against any all claims for loss of or damage to property, or injury or death of person or person resulting from or arising in any manner out of Customer’s use, placement or possession of equipment furnished under this Agreement and pay all costs and expense, including reasonable attorney’s fees, incurred by Company in connection with such claims. The Company shall not be liable for its failure to perform hereunder due to contingencies beyond it reasonable control including but not limited to strikes, fires, whether, equipment breakdown or acts of God.
- There is a $35.00 service charge on returned checks payable to Global Waste Management LLC. by Customer.
